Section 162 of the Law Reform Ordinance (XII of 1972), Section 3, once resigned from the seat of Moderator, who was elected Moderator of the Union Council, nominated his papers for the General Assembly seat. Were submitted to fight. To fulfill the requirements of Article 62 of the Punjab Local Government Ordinance 2001, he resigned from the seat of Union Councilor who, after the scrutiny, approved the nomination papers of the respondents and nominated them to the contesting candidates. The list was entered and he remains legally a candidate, but in the meantime he continues to hold office because the moderator of the Union Council respondent claimed that he had resigned. And the provisions of Section 162 of the Punjab Local Government Ordinance 2001 did not apply to them. The matter and that his retention of the position of Union Council Moderator was a valid affidavit before the Returning Officer indicated by the Respondent that he had resigned from the Union Council Moderator's Office. And under section 162 of the Punjab Local Government Ordinance 2001, the resignation submitted will be accepted and considered effective. And consequently could not be recovered under any law or circumstance. The respondent had resigned from the position of moderator and was named in the list of candidates eligible to participate in the general election.
