STATE versus HAJI KABEER KHAN
Section 9 (a) (b) Criminal Code of Conduct (v. 1898), Section 497 (5) Constitution of Pakistan (1973), Article 185 (3) Guarantee, cancellation of accused's post-arrest bail on medical ground, through High Court affirmation. The accused never went to jail, but he was being treated as an inpatient at a renowned hospital in the country, where he had undergone coronary bypass surgery and was on medication, while in hospital, he guaranteed. Approval was never requested. He was dissatisfied with the treatment he was receiving, and it was alleged that he would not be entitled to a guaranteed grant when he was treated in hospital or jail. The report, summoned by the Supreme Court to the Medical Board of the relevant institute, states that the health of the accused is improving.
