Keeping in mind the provisions contained in Sections (1) and (2) of Section 497, Sections 49 of the CCP, for the grant of a Section 497 bail, the Principal Duty of Court before the release of the accused on bail. In the case of bail and failure of the prohibited clause, especially in section (1) of section 497, the status of CCP could not be granted. The reason for the straightforward case was that it was a matter of further investigation and that section 497 was to seize the material available on the record, in the guarantee stage, without keeping the entire provisions of the CR PC. Whether the first accused before the court could be linked to the crime under investigation and, therefore, no detailed inquiry was required by the court
