BOARD OF GOVERNORS, AREA STUDY CENTRE FOR AFRICA AND NORTH AMERICA versus MS. FARAH ZAHRA
Section 3 High Court (Lahore) Rules and Orders, Volume VCAPE I, R4 Limitation Act (IX of 1908) Section 5 The appeal filed by the appellant regarding the delay of appeal was permanently dismissed by the appellant. ? The delay was due to obtaining a certified copy of the judgment approved by the High Court. Generally, the Supreme Court did not exclude the time spent to obtain a certified copy of the judgment, but both parties believed that a certified copy was required to file an intra-court. The appeal and the reason for this was that the issue of obtaining the certified copy was not taken up by the respondent before the Division Bench of the High Court which passed the decision, nor in the short statement filed by the respondent before the Supreme Court and Neither had made such a mistake during the arguments, therefore, precautionary orders and the time spent by the Supreme Court to obtain a certified copy of the judgment were removed by the Division Bench of the High Court and the appeal was decided. A new decision was sent to the High Court
