Sections 2 (BB) and 2 (C) Provincial Employees Social Security Ordinance (X, 1965), Article 20 Constitution of Pakistan (1973), Article 199 Constitutional Application Advantages, Recovery of Employees Provided by Contractor Applicant, Assistant Applicant refused to be employed by the Contracting Adjudicating Authority and the Appellate Authority. Similarly, both of them decided the case against the applicant and the applicant company was covered under the Employees' Old Age Benefit Act 1976. Authorities were entitled to pay for the demand raised. The ploy taken by the applicant was that the contractor was given some work which employed the employees and the contractor was responsible and the applicant was not a party to the mutual agreement between the contractor and the employees.
