MUKARRAM SHAH versus SINDH LABOUR APPELLATE TRIBUNAL AND OTHERS
Sections 25A, 37 (3) and 38 (3) of the West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance (VI of 1966), Section O15 (3) of the Constitution of Pakistan (1973), Article 199 of the Constitution Petition Service Complaint Employees were dismissed after dismissing employees after a charge sheet and allegations of inquiry against them that they, along with two other workers, committed theft and that employees were caught red-handed. And there was enough evidence against the employee to establish a labor court and appellate charge against him. The tribunal below rightly dismissed the complaint filed by the employees against their dismissal order, in the absence of any material misconduct or legal jurisdictional error, finding the conciliation of the Labor Court and the Appellate Tribunal.
