Section 10 (2) of the General Clause Act (XX of 1897), Section 24 of the Constitution of Pakistan (1973), Article 109 Constitution Allotment Temporary Farming Scheme Applicants were allotted land in 1984 under the 1984 Temporary Farming Scheme. And their allotment was extended by the Board of Revenue from time to time in 1995 issued a notification for grant of proprietary rights to the proprietary rights of such scheme applicants / allies, and thus to the applicants. Atomic Energy Scheme Petitioners were allotted their rights instead of granting proprietary rights. The EL Board of Revenue was dismissed, five issues were set on further challenge and the matter was remanded to the Commissioner.
