The bank's claim was partially admitted to the extent of the section 11 interim injunction claim, and the defendant's banking court partially denied it when the bank claimed that the defendant's legal claim case was dropped. In the case of section 11 of the Financial Institutions (Rehabilitation) Ordinance, 2001, the Banking Court, instead of rejecting the leave application to defend the case right, rejected the Financial Institutions (Security of Finance) Ordinance. This case should have been decided under Section 11. The decision and the decree passed by the Banking Court in 2001 were in contravention of the provisions of the law and it was decided that the petition for leave to defend the case filed by the defendants and the Bank of Suits be remanded to the Banking Court. On which the appeal was allowed.
