HAJI KHAN versus ALI AHMED
In the appeal against the prosecution of the immunity from the crime of section 171717 to the Criminal Procedure (XLV of 1860), section 302/34, the witnesses were summoned only by the evidence of the prosecution witnesses who were closely related to each other. Despite the fact that other villagers also joined the ward, none of them was cited as a witness to the contentious version of the complainant's or prosecutor's testimony, but the complainant was not his eyewitness. The incident was reported by one of the witnesses, but whose evidence was not believed by the trial court in three eyes. One of the witnesses was denied, the other did not support the prosecution's case and was declared an enemy, while the third one was denied by the trial court because its evidence was weak.
