ABDUL RAZZAQ AND 2 OTHERS versus THE STATE
The transfer of the case of section 6 case6 was tried on the basis that the sessions judge who proceeded with the trial was exchanged, while the case was fixed for adjournment in the jail since July 2002. The dispute was that either the Sessions Judge in charge should be instructed to record the decision in this case or the matter should be transferred to another Additional Sessions Judge as the case has been concluded and the complainant has filed the prosecution case. Is not supported because the parties had agreed outside the case, the court and the accused only to announce the verdict. While moving around, the case was transferred to another Additional Sessions Judge who will hear the case according to law.
