MUHAMMAD DIN (DECEASED) THROUGH MUJAHID HUSSAIN QASIM AND OTHERS versus MUHAMMAD AMIN AND OTHERS
Article 42 Constitution of Pakistan (1973), Article 185 (3), in the interest of the plaintiff's two lawyers for the trial of the plaintiff, challenged the validity of the decree obtained after the death of the plaintiff while the witnesses appeared. That, in the presence of such decree, was approved. Relying on their evidence in the interest of the respondent trial court, it was concluded that such a decree was properly approved by the appellate court and the High Court has maintained such findings in the interest of the defendant. The predecessor did not challenge such a decree in his lifetime and the court dismissed the petition and refused leave.
