The Service (Special Powers) Ordinance, the removal of the NWFP from 2000, was accepted by the applicant before the High Court in its constitutional jurisdiction but, without success, the applicant had raised before the Supreme Court that he was not a civil servant. Therefore, they cannot do this to request the service tribunal's jurisdiction
