MUHAMMAD ASLAM versus MST. KUNDAN MAI
Article 12 (2) of the Constitution of Pakistan (1973), Article 85 (3) of the Decree, attempted to sign the jurisdiction of Fraud on the ground that there was no fraud in the court which issued this decree. The decree should have committed fraud in the court which passed the verdict, but if the decree was obtained through fraud between the parties while hiding the facts, the order was passed. And will be questioned about the validity. Decisions were to be made on the existence of the Tamalakamese or any other party's qualifications.
