The Sections 8, 14, 20, 30 and 41 awards, together with the failure to present reasonable grounds, were referred to the arbitrator for a decision in the terms of the arbitration agreement and a clause in the sale agreement stated in clear terms. It was said that machinery or land, buildings and old plant structures would not be subject to sale and the area of the old plant would be surrounded by a boundary wall. Petitioner, including the old plant, sought to separate the award on the basis that the award was made in contravention of the sale agreement between the parties and there was no reason to support the award.
