Sections 9, 10, 15 and 21 of the Civil Procedure Code (v. 1908), OX, Rr 1 and 2 suit were dismissed by the Bank of Banking Court before filing a lawsuit for filing accounts against bank leave, but better recording After the plaintiff's statement found that the plaintiff did not show any reason for the action, after the defendant discharged the verdict, the Banking Court was obliged to compile the matter and bring the parties under Order X, CPC. But was allowed to examine the parties. The actual issue in dispute and such fine statements cannot be used as a means of trial. The High Court allowed the appeal, set aside the defamatory order and asked the banking court for its decision in accordance with the law. Received remand.
