AZAD KHAN versus YAQOOB
Section 10 Limitation Act (IX of 1908), Article 148 Constitution of Pakistan (1973), Article 185 (3) of the defendant on behalf of the mortgagor sought a declaration that the mortgage is pending and that the owner is the owner of the suit at trial. The plaintiff is not a plaintiff. The lawsuit was dismissed as time-bound, in possession of land. Such a decision was upheld by the appellant court and the High Court, explaining the admission to the Collector that he did not occupy the land, claiming that he did not occupy the land. Was it that during that time, he had occupied the land the plaintiff could not be satisfied with the record that he was on the ground before the case was filed and if so what was the nature of his possession?
