MUHAMMAD ZAMAN MANGAT versus MUHAMMAD AKHTAR
Section 2302 (b) Constitution of Pakistan (1973), Article 185 (3), appealed against the incident of imprisonment on the first night of the lunar month at 2 o'clock in the vicinity of the complainant's residence near Nala. The victim was taken out in the same condition in which the eye witnesses could not present any plausible reason for being present at the time of the night record at which the eyewitnesses could identify the accused. The eyewitnesses were merely witnesses of the occasion, and their stated account did not affect trust. The prosecution failed to encourage theft because the human blood was not stained because medical evidence was not available to the account. The High Court had given reasons for acquittal of the accused but in these circumstances the appeal of the complainant was denied.
