MUHAMMAD IQBAL versus THE STATE
Section 2302 (b) / & 34 & 7 307 / Constitution Constitution of Pakistan (1973), Article 185 (3) was charged with surrendering without any weapon under which they were charged under Article 185 (3) of the Constitution. A petition was filed in the Supreme Court in which the petition was made. Without the aforementioned plea, the charge of surrender in detention should be entertained solely on the basis that he was the sole breadwinner of his family and if he surrendered in his arms, his family would suffer irreparable harm. It was hardly a justification for entertainment. Under Article 185 (3) of the Constitution, without surrender of the accused he surrendered himself. His request was dismissed accordingly.
