NAZIR GUL versus ZAR GUL
Section 497 of the Criminal Procedure (XLV of 1860), Section 302/34 bail, allowed two versions of the trial against the accused, one being that the victim committed suicide and the other by her father. The accused was killed. Because of their strained relationship with them, the FIR was based on a suspicion that no one could firmly replace the evidence of his bail, no witness to the incident, except one incident. No abusive articles were recovered. When he was last seen in the company of the accused, he could not form the basis of denial of bail because he was living in the same house as the victim's daughter-in-law.
