Section 417 Appeals Against the Scope of Breath An appeal against a conviction is strictly examined in the evidence, but in the appeal against Breath, it is not so rigorous, as to make a proper analysis of the evidence through a trial. Will consider the appropriate weight and consideration. The court will not interfere in acquitting the accused simply because re-evaluation of the evidence may lead to the conclusion that the accused acquitted, provided both of these conclusions are reasonably possible.
