DR. SYED RAZA GARDEZI versus NAZAZ ALI
Section 3 High Court (Lahore) Rules and Order, Volume Five, Chapter 1A, R4 Limitation Act (IX of 1908), Section 5, 12 (2), 14 and Article 151 Sindh Chief Court Rules (O Section), R 14 (2) in accordance with an agreement to delay the appeal of the intra-court through impartiality. The only thing left to do in pursuit of a certified copy of improper judgment and order issuance was that he was well-intentioned to obtain such a certified copy, thus wasting his time. No valid reason was set up to file such a certified copy. The reason for the delay in obtaining such a copy would not be sufficient to delay the application for condolence was silent on a particular date on which the appellant found out about the unknown decision on the date of applying for the certified copy. Appellant's knowledge was taken as a date, however, due to lack of clarity the appeal was banned on the hopeless because the appeal was not filed immediately upon receipt of the certificate. The copy of the judgment and the decree showed no good reason for the delay, the petition was dismissed under section 5 of the Limitation Act, 1908, consequently the appeal was dismissed as time-barred.
