The ultimate jurisdiction in Articles 12 and 13 is to impose a crime in the federal government, otherwise a felony, where the nature of the crime seems trivial or the extradition request is not made in good faith, or the extradition is not in the interest of justice. Or it would be unfair or unreasonable to surrender to a convicted felon, the Federation may not only stop proceedings against it but may issue a termination order or summons despite the positive opinion of the inquiry magistrate. On the contrary, where the Federation is of the opinion that it is better to surrender the fugitive offender and the inquiry magistrate's opinion for acquittal of the fugitive is not in accordance with the law, but is merely an open road to the Federation.
