Sections 2A and 4 Constitution of Pakistan (1973), Article 212 (3) Removal of Bank Employees from Involvement in Criminal Trial; On such involvement, the Bank employee absorbed himself from the duties of bank officials. Issued and, through the opportunity of hearing from the bank employee, the Service Tribunal removed from his employment retained the order that his absence was inevitable, irrespective of whether he was absent. Accountability or inevitability cannot be the sole concern of a public bank. In the absence of goodwill, the loss of goodwill proved to be a matter of relaxation by the employee and the retention of the job was not in the interest of the bank; it was rightfully removed. The leave to appeal was denied.
