ZEB SAR versus MST. KOSAR
Section 8 Constitution of Pakistan (1973), Article 199 Compulsory abolition of marriage on the basis of plea, the wife accused her husband of wrongdoing, and the wife also accused her mother-in-law of being polite. Tried to provoke the Family Court. The case was dismissed but the appellate court allowed the appeal and the marriage was dissolved on the basis of khola. In view of such factual and unpleasant relationships between justifications, there was a real reason for their separation on the basis of khula: spouses cannot. They were forced to live together in a hateful union and within God's boundaries and in such a situation the judge (court) was forced to end the marriage bond between husband and wife, in the judgment by the husband. No illegal or legal impairment was identified. The appellate court found differences between the couple, it was better for them to separate and dissociate. Instead of continuing the marriage to lead an unpleasant life, the High Court refused to interfere with the decision and the family court's granting of the petition was dismissed under the circumstances.
