Section 497 (5) of the Conduct Regulation (XLV of 1860), Section 354 was filed after the delay of one year, one month and eighteen days after the cancellation of the bail, the accused also on section 302/109/148/149. The case was registered under PPC, before the present case in which the complainant's son was identified as accused and delay in reporting the matter to the police in a hostile and illegitimate background was crucial. It was reported that these privileges have been misused since his release. Cancellation of bail granted to the accused on bail was not in the interest of justice under the circumstances accordingly the petition was dismissed.
