MESSRS MEHRAJ (PVT.) LTD. versus MISS LAIMA SAEED
Section 15 (2) (ii) Constitution of Pakistan (1973), Article 199 Constitutional application for payment of rent rented by the tenant in the pretext of negotiation for sale with the landlord tenant controller and appellate court. The tenant was found to be simultaneously in breach of payment or non-payment of rent. The tenant authorized to pay the rent failed to explain how withholding the rent for the duration of the dispute could help him finalize the sale transaction or sell the tenant premises. What happened to this alliance with the negotiations, all such facts and various alternative requests by the tenant were indicative of the fact that their claims could not be substantiated because of the proper review of the evidence available on record. The orders based on it were not correct, the High Court dismissed the constitutional application in the constitution
