KARACHI ELECTRIC PROVIDENT FUND versus NATIONAL INVESTMENT (UNIT) TRUST
Sections 9 and 2 (d) (e) suit against National Investment Trust Maintenance Claimant for holding the value of NIT certificates by its holder, having become a shareholder in the trust as a unit certificate. This is not in accordance with Article 9 of the Ordinance because neither the customer nor the banker's relationship exists between the parties, nor is there any agreement with regard to any financial assistance by the plaintiff. Such relations showed the High Court behaving like a common suit to handle the matter at its core.
