INDUSTRIAL DEVELOPMENT BANK OF PAKISTAN versus MYFIP VIDEO INDUSTRIES LTD
Section 19 (7) Investigating claims and objections in respect of machines executing the decree, the applicant (s) claimed that they had leased the machines to the decision maker and their failure to pay the monthly rent. However, the order for its recovery (bank) has not been able to prove the applicant was not eligible to claim possession of the machines or to show that the order obtained by the applicant. The amount was for an amount except that the outstanding rent arrears were recoverable and payable by the applicant to the decision makers. The payment was kept on record by the applicant in the form of sales invoices and lease agreements, etc. On the contrary the applicant had no material, on the basis of such documents, proved to be the owner of such machines, and As such, he was entitled to seize the same petition
