ABDUL KHANAN versus GOVERNMENT OF KHYBER PAKHTUNKHWA
Arts 2A, 4, 25, 27, 28, 199 and 212 Police Rules, 1934, are outside the scope of the Twelfth Constitutional application, subject to the jurisdiction of the High Court of Scope Locus Penitentiary, the application of Article 212 of the Constitution. The change of the High Court in matters relating to the terms and conditions of public servants was not linked to the terms and conditions of public employment. In turn, development was not a regular promotion, but a source of reward in the case of extraordinary circumstances. With regard to fundamental rights such as citizens' equality before the law and the right to equal protection of the law under Article 25 of the Constitution, the High Court had jurisdiction over the matter, which is a breach of the constitution and the law. This will not happen because such a process has been finalized and past and closed transactions and its promotion was against the constitution and promotion of Islam, for the purpose of promotion of performance by the same officer.
