SALEEM-UR-REHMAN versus FAQIR HUSSAIN
Article 145 Constitution of Pakistan (1973), Article 185 (3), the Sessions Court, at the relevant time, practically appreciated the evidence regarding the facts of the parties' actual physical possession of the land. The PC and its decision were well-reasoned and well-grounded, which was neither misleading, nor the reading of false news nor the evidence, suggesting that in any case the merits of the review were merely due. It did not end with the difference in the definition of evidence. The concluding High Court should have intervened only when it was satisfied that the lower courts had committed gross injustice in defining the evidence due to the misuse of the Court Sessions Court proceedings. As a result of the leave application for appeal, the appeal was changed which was allowed and a reasonable decision of the Ampu High Court was set aside and the Sessions Court decision was restored.
