In this case, there was no effect of any recovery from the accused nor any identity parade was held so that the name of the accused involved in the crime was revealed first. About 27 days after the FIR was registered before the investigating officer and about a month and a half after the alleged incident, such an allegation was made only on the identity of the accused by the complainant in the police custody. Continuing detention of the accused in the jail after completion of the investigation was not likely to serve any profitable purpose, further investigation of the case was demanded against the accused. The accused was admitted to the bail on condition of anonymity.
