MST. PARVEEN QASIM JAN versus HABIB BANK LIMITED

Sections 9 and 21 of the Transfer of Property Act (IV of 1882), Section 588 Guardian and Wards Act (VIII 1890), Section 7 Bank Debt Recovery Minority-owned mortgage against such mortgage, for the borrower. The bank was the father of a minor who took out a modern loan and was appropriately guarded by a Guardian judge for mortgage of property owned by minors for a loan amounting to Rs 16 lakh, said the Guardian Judge Bourwar. Submit documentation on the title of the property. With the bank, the decision was made in favor of the bank for implementation of the collateral mortgage deadline and the loan of Rs 90 lakh and the property of the minor was handed over to the bank in the process of decree taken by the minor. The maximum liability of the minor was in the range of Rs. 16 lakhs and not the maximum justification. No permission was ever sought by the Guardian Judge nor to submit any assistance, therefore, as a result of the guardianship the minors exceeded their powers, when submitting the title deeds, The bank did not ask the lender for permission from the relevant court finding of the banking court, as a suitable mortgage was also formed in favor of the bank, which was covered. The entire financing facility was beyond jurisdiction because the borrower was legally obliged to obtain permission from the Guardian Judge for the execution of the mortgage and submitting the title act. Only Rs 16 lakh was in the process of mortgages and no further. Banking court upheld the order of over Rs 16 lakh by the High Court.
