NAEEM AKHTAR versus THE STATE
The Pakistan Penal Code Sections 302, 365 and 411 of the Anti-Terrorism Act (XXVII of 1997), Sections 6 and 7 of the Terrorism and Terrorism Act of Pakistan (1973), Article 185 (3) argued that accordingly Witness is testimony. Punishment cannot be the basis of crime. The trial was illegal by a special court established under the Anti-Terrorism Act 1997. That the evidence of the prosecution did not affect the trust. That the accused is guilty of reckless, brutal and extrajudicial murder without any justification and can be sentenced to death. The High Court has erred in stating that the accused was not covered under Section 6 of the Anti-Terrorism Act 1997 and accordingly cannot be punished under Section 7 of the said Act and this is surprising. It is enough that the accused who were tried in absentia. The death sentence was awarded by the trial court along with other convictions; the high court also acquitted by a wrong verdict.
