GHULAM MUSTAFA versus MUHAMMAD ALAMGIR
In the case of the Special Relief Act 1877 Sections 8 and 54 Civil Procedure Code (v. 1908), O VII, R 11, the case for the dismissal of the accused's title in relation to the suit property and the adjudication of the permanent order was finally passed by the plaintiff in the case. Decided in favor of the defendant. He contended that he had purchased the suit property through the sale deed registered by the project and that he was the owner of the suit property, in which case the defendants filed a petition to dismiss the case. His right was decided by the Supreme Court in his favor. There was no cause for action. The name of the alleged sale deed under which the plaintiff sued was not mentioned in the sales deed itself, which had no title to the suit property itself. Could not sell. The plaintiff's case for sale which caused it to be void, the case was sold, there was no cause for action in favor of the plaintiff's trial. Lee rejected under OY VII, R 11, CPC
