DIN MUHAMMAD QURESHI versus GOVERNMENT OF SINDH
Sindh Buildings Control Ordinance 1979 Section 6 (2) Constitution of Pakistan (1973), Article 199 Constitutional application to inform the court of the demolition of the building by the authority shows that the houses were destroyed before the building was destroyed. The eviction notice was issued, but in the absence of a Certificate of Occupancy under Section 6 (2) of the Sindh Buildings Control Ordinance, 1979, possession of any part of the building would be illegal, to protect the occupants of the building from occupation. No interim or final order was passed by any of the three courts. The High Court had given the authority months to evict the occupants of the building, if necessary, by force and perform their duties in accordance with the law.
