TEHSIL MUNICIPAL ADMINISTRATION versus AUTHORITY UNDER PAYMENT OF WAGES ACT AND COMMISSIONER WORKSMEN\'S COMPENSATION, GUJRAT
Section 7 Constitution of Pakistan (1973), Article 199 The claim of private person, the determination of authority under the Salary Wages Act, 1936, was approved by the Supreme Court on the basis of the Wages Act of payment under the Town Committee, Gakhar Mandi V, Gujranwala. And 57 others reported the PLD 2002 SC 452 petitioner's complaint that the authority had passed the order without deciding the jurisdiction's issue on the question of jurisdiction over jurisdiction. The decision was to be made before and on the basis of the content. The light of the evidence presented before the Authority did not assert its jurisdiction in the matter without giving any reason and concluded only with a good conclusion that the application of the private defendant was to remain before him where the authority was bound to consider the evidence. And the relevant dispute of the parties is within its jurisdiction and the order passed by it, not by authority, was not lasting. The Supreme Court set aside the order passed by the authority and the matter was remanded to the decision in light of the record and evidence of the law. Applicable application was allowed accordingly
