RASHID AHMAD versus MUHAMMAD KHAN
Section 6 Land Reform Regulation, 1972 [MLR 115], para 25 was filed for retaliation because of a change in the suit land seller. At the time of the sale the suit was a tenant in the land and the landowner had a high pre-emptive right on the land, which proved from the record that the defendant was a custom tenant. Was occupying the land, but the two courts ruled without trial. In view of the said document, the High Court set aside the orders of the wrong courts and the courts below, and dismissed the case.
