After obtaining fresh evidence, the justification was to be avoided as far as possible and the order should be given only when the parties in the present case took advantage of the opportunity, the trial was presented in court and in this regard. There could not be a legitimate complaint. Respondents having appellant before the appellate court did not even complain in the appeal of the memorandum that proper cases were not set up. The key to covering all this dispute was conclusive and concise, the remand order issued by the appellate court was set aside and the case remand was obtained.
