The only evidence against section 302 (6), 365 A & 201 of the accused was the retrieval of available articles, the defendant could not possibly have the said articles, which could be easily purchased by the commoner. Such a recovery was not enough to even invite the victim's chapel to hang his house, the accused was not named in the FIR, though it was registered five days later. Had been acquitted of the situation.
