MUHAMMAD JAHANGIR QAMAR versus DISTRICT JUDGE/ELECTION TRIBUNAL, PAKPATTAN SHARIF
Section 14 (e) Article 199 of the Punjab Local Government Election Rules, 2000, R18 (3), Constitution of Pakistan (1973) was disqualified applicant of the candidate after the election, was the candidate for the post of deputy nominee. At the time, it was raised that the co-candidate of the Nazim seat was disqualified due to non matriculation, the co-candidate was allowed by the High Court to contest the election and after the election the applicant and his co-candidate. Was declared a Returning Candidate because of the election of the Chief Election Commissioner on the basis that the co-candidate was the Punjab Local Government. EC Ordinance 2000 was declared ineligible under section 14 (e), failed as a result of the candidates were declared candidate retired. The applicant claimed that since the Nazim was disqualified, the applicant could not sit under the election, R18 of the Punjab Local Government Election. Ones rolls, the seat of the Nazim was not vacated due to the factual seat after the 2000 elections. In fact, this objection was raised at an early stage. According to the Punjab Local Government Election Rules 2000 RR 18, the nomination of both candidates was rejected by the Chief Election Commissioner rightfully invalidating the selection of the applicant and his accompanying candidate as the High Court approved the Chief Election Commissioner. Order was refused to be interrupted The petition was dismissed accordingly
