MUHAMMAD TARIQ ZAKHMI versus ELECTION TRIBUNAL
Punjab Local Government Election Rules 2000 R81 Constitution Pakistan (1973), Article 185 (3) Election Petition The re-counting of the ballot papers was declared as a candidate for the election tribunal, but the respondents filed the election petition. The Election Tribunal accepted. On the basis of counting of votes, the respondent was declared successful because 706 legitimate votes were cast in favor of the applicant who got 687 votes. The order of the Election Tribunal was suspended in the Constitution but the High Court on behalf of the Tribunal. Refused to interfere with the order given by The applicant was of the view that the votes cast in this constituency could not be re-counted by the Election Tribunal, nor could any electoral application be filed outside the scope of R 81 of Punjab Local Government Election Rules 2000, The correctness of the judgment was correctly stated by the High Court. Refusing to interfere with the counting of votes and consequently the declaration of response, as a candidate where there was a fair trial between the parties, no interference case was presented in the High Court verdict.
