The constitutional petition raised the question as to why the candidate who was deposed was not eligible under Section 14 (g) of the Punjab Local Government Election Ordinance 2000 because of how he was holding this seat. As per the month, section 14 (g) of the Punjab Local Government Election Ordinance, 2000 states that since the person on leave is considered to be in the job, the candidate was acting as Labor Counselor without any legal authority. He was constitutionally removed from office. Application was allowed under the circumstances
