RAHIM JAN versus SECURITIES EXCHANGE COMMISSION OF PAKISTAN

The applicants of the Securities and Exchange Commission of Pakistan Act, 1997, preferring a constitutional petition before the High Court, instead of tiling the appeal within sixty days against the commission's order, which was withdrawn and an appeal was filed. The court rejected the appeal when the ban was imposed. In this case the date was not fixed by the Commission and even if it did not appear on the due date, there was nothing said in the delayed plea that the appeal was filed within that period. What prevented her from doing so? In the judgment, the limitations set by the High Court before the High Court's view that the appeal was withheld over time were not subject to any legal infection.
