The fact was discovered that the passage was not part of the defendant's property and was being used. Since the plaintiff was the only means of passing and reaching her home, it was established to ease the need. The following court was not subject to any legal weakness. The Supreme Court refused to intervene in the decision. And the court denied the appeal
