AMJAD LATIF versus ALLIED BANK OF PAKISTAN
Financial Institutions (Recovery of Finance) Ordinance 2001 Section 22 Banking Tribunal Ordinance (LVIII of 1984), Section 6 Appealing and Defending Appeal Leave, Complying with the Decree of an Banking Court and Passing the Decision And the decree did not refer to the leave order nor did it conclude that the order granting the conditional leave was not applied by the appellants. The High Court, without trial, found no justification for indictment of the bank as a regular case of trial, which was legal, at least in relation to the existing appeals. The creditors' decision and the representatives of the Decree issued by the Banking Court were set aside and the case was remanded to the Banking Court for judgment, accordingly the appeal was allowed.
