MUHAMMAD UMER QURESHI versus THE SENIOR MEMBER BOARD OF REVENUE SINDH
Sindh Civil Servants (Probation, Certification and Sanity) Rules 1975 Rr 9, 10 & 11 Sindh Civil Servants (Appointment, Promotion and Exchange) Rules, 1974, R5 Sindh Service Tribunals Act (XV of 1973), Section 4, Seniority and Promotion Determined Government Employees Despite being appointed as first Junior Clerks rather than Co-Government Employees, their seniority was assigned as Senior Clerk to Co-Government Employees. The seniority was determined by the Public Promotion Committee, constituted by law. No recruitment nor rules were enacted to promote the post-up nor the junior clerk's seniority list. The time was framed with unnecessary hesitation, excessive authority over authority and the authority's authority to show that this act of authority was not only a social act, but bad in the eyes of the law. The policy, which is not legally promoted, has mandated by the competent authority to compile a seniority list of all civil surveys. Relevant dates were designated as Junior Clerks and such listings should be communicated to all concerned and if there are any objections, if any, promotions should be properly addressed as Senior Clerks. , Then, seniority should have been based on the principle of low fitness, but they were not resorted to by the relevant authority Order of Authority as important codal facilities and cases were remanded to decide accordingly. ?
