Service Tribunals Act 1973 Section 4 Police Rules, 1934, 8 12 21 Constitution of Pakistan (1973) Article 212 (3) Employed from the employment of a public servant in a criminal employment, the employee was dismissed from employment during the scope of the appeal. The servant was acquitted by the trial court, but the departmental authority dismissed his appeal. The civil servant filed an appeal before the service tribunal and requested that if his appeal be allowed to be restored to the service, the Additional Advocate General representing the department said that the objection to the proposed course was followed by the service tribunal. Accepted the appeal in the terms specified. The Department's acknowledgment was that the Service Tribunal should have exercised an independent mind on the subject, rather than allowing the appeal based on the privileges granted by the Additional Advocate General. The facts of this case, and it was also noted that the appeal was time-bound was for the Department to rehabilitate a civil servant without any additional benefits from the Additional Advocate General. The Supreme Court intervened in such privileges. The application for leave of appeal was rejected
