Section 2302 (b) evidence was appreciated in the dark hours of the night, in light of which the accused was not captured by the investigating officer who admitted that the source of the light at the scene was not confirmed. Eyewitnesses could not possibly see who fired the sole bullet that targeted the deceased, nor did any crime be recovered from the scene of the incident, nor recovered any weapons of any crime. Had happened, the co-accused in front of him had been acquitted. The benefit of the doubt could not be relied on in the interest of witnesses and non-judgmental witnesses; medical evidence in the absence of independent confirmation did not conform to the prosecutor's testimony. Could have been done. Under the circumstances, the accused was extended and accordingly he was acquitted
