TAZEEM AKHTAR versus THE STATE
Section 2 evidence2 Definition of evidence Medical evidence strongly denied the prosecution's version. Eyewitnesses did not see an incident at the hospital where the victim was taken to the hospital and after the arrival of the police and the number, the injuries on the body of the victim were attributed to the three accused. The FIR filed after the initial investigation was not admissible in the evidence, which testified at the hearing, which was denied by the trial court, which involved the two accomplices. The accused had to be examined with extra caution against the accused; the victim's relationship with the witnesses, no doubt, had no basis to deny his testimony, but in this case both witnesses were irrational. And there were interested witnesses whose motive was to get the accused involved. The deceased had lost his life due to a single bullet, but according to the prosecution, all three were hockey-hired, and in such a situation, it was extremely unsafe to simply blame the accused as the main culprit. There was no help from the prosecution in recovering the rifle from the accused's house due to the injury. Since the case was not seen by an independent witness and the recovery memorandum was signed by the deceased's real brother, it was taken advantage of and he was acquitted on the spot.
