HAFIZ MAHBOOB ELAHI versus AHMAD KHAN ALIAS KHANU
Section 302 (1973), Article 185 (3) sentence of the Constitution of Pakistan, the change in the death sentence convicted by the trial court was changed by the High Court to life imprisonment on appeal, the complainant appealed against the decision. The High Court has applied for leave on the basis that it was a cold-blooded murder which justifies the maximum punishment. The High Court has sentenced the minors to the minimum on the basis of the incident in such district. Was presented where people usually carry guns and such incidents have occurred. The appeal was granted by the Supreme Court for consideration as to whether the High Court observations could be treated as a matter of lessening the sentence.
